Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of the Elite Cabo Services mobile application, website, and associated services (“Platform”). By creating an account, accessing, or using the Platform, you fully agree to these Terms. If you do not agree, you must not use the Platform.

1. Nature of the Platform

Elite Cabo Services (“Elite Cabo”) operates as an intermediary platform connecting users with independent third-party service providers (“Providers”) offering hospitality, concierge, wellness, personal care, transportation, housekeeping, and related services. Unless explicitly stated, Elite Cabo does not directly provide the services booked through the Platform.

2. User Eligibility

By using the Platform, you represent and warrant that:

• You are at least 18 years of age.
• You have the legal capacity to enter binding agreements.
• You will provide truthful, accurate, and up-to-date information.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity performed under your account.
• Immediately notifying Elite Cabo of any unauthorized access.

4. Services Provided by Third Parties

Providers are independent contractors and are solely responsible for:

• The quality, execution, and safety of the services they offer.
• Licenses, certifications, and compliance with applicable laws and regulations.
• Providing their own equipment, materials, and staff when required.

Elite Cabo does not supervise, control, or guarantee Provider performance and is not liable for their actions, errors, omissions, delays, or conduct.

5. Payments, Fees, and Billing

When booking services through the Platform, you authorize Elite Cabo and its payment processors to charge your selected payment method for:

• The service cost indicated at the time of booking.
• Applicable taxes and fees.
• Any additional or optional charges (upgrades, urgent service fees, gratuities).

Payments are processed securely through third-party gateways. Elite Cabo does not store full credit card information on its servers.

6. Cancellations, Changes, and Refunds

Policies vary depending on the service and Provider. You acknowledge that:

• Refunds may be partial, full, or not applicable depending on Provider policies.
• Late cancellations or no-shows may incur full charges.
• Elite Cabo may assist in communication but does not decide or guarantee refunds.

7. Conduct, Personal Information and User Obligations

You agree not to:

• Harass, threaten, or mistreat Providers or other users.
• Use the Platform for illegal, fraudulent, or harmful activity.
• Provide false information or stolen payment methods.

In order to protect all parties and to preserve the integrity of the Platform, both Guests and Providers expressly agree to the following:

• Guests and Providers must not exchange or request personal contact information with the purpose or effect of bypassing the Platform, including (without limitation) personal phone numbers, email addresses, social media handles, direct messaging accounts, or direct payment details such as bank accounts, payment links or wallets, outside of the tools that Elite Cabo may enable within the Platform.
• Guests must not attempt to book, pay for, or re-book services directly with a Provider outside of the Platform in order to avoid service fees, commissions, or any commercial conditions established by Elite Cabo.
• Providers are strictly prohibited from soliciting, offering, or accepting direct bookings or payments from Guests outside the Platform when the relationship was initiated through Elite Cabo.

Guests acknowledge that any attempt to circumvent the Platform or to arrange services directly with a Provider may result in the immediate suspension or termination of their account, loss of access to the Platform, and the cancellation of any current or future bookings.

Providers acknowledge that any such conduct constitutes a material breach of their independent contractor or service agreement with Elite Cabo and may result in immediate deactivation of their profile, termination of their commercial relationship with Elite Cabo, and potential legal and contractual liability, including but not limited to the obligation to compensate Elite Cabo for any lost fees, commissions, or damages arising from such breach, in accordance with the agreement they have signed with the company.

8. Property Access and Safety

Users must provide safe access for Providers to perform services. This includes:

• Providing accurate addresses and instructions.
• Informing Providers of any risks, restrictions, or building rules.
• Ensuring the environment is reasonably safe and legal.

9. Intellectual Property

All logos, designs, trademarks, text, and media belong to Elite Cabo or its licensors. You may not copy, modify, distribute, or reproduce any content without written authorization.

10. Limitation of Liability

To the fullest extent permitted by law, Elite Cabo shall not be liable for:

• Any damages, injuries, losses, or theft resulting from Provider services.
• Service dissatisfaction, delays, cancellations, or Provider misconduct.
• Technological issues, system outages, or data loss.
• Circumstances beyond its reasonable control (force majeure).

11. No Warranty

The Platform is provided “as-is” and “as-available,” without guarantees of uninterrupted or error-free service. Elite Cabo disclaims all implied warranties to the extent permitted by law.

12. Suspension or Termination of Accounts

Your account may be suspended or terminated if:

• You violate these Terms.
• You engage in fraud, abuse, or harmful behavior.
• There are repeated payment disputes or chargebacks.
• Security or legal concerns arise.

13. Privacy

Personal information is handled according to the Elite Cabo Privacy Policy. By using the Platform, you consent to data processing and storage as described therein.

14. Dispute Resolution

Parties agree to attempt amicable resolution of disputes. If unresolved, matters may be submitted to the competent courts of the relevant jurisdiction, subject to applicable law.

15. Modifications to These Terms

Elite Cabo may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated version once posted.
